JACETANIA JUSTICE REPORT OF ARAGON ON OUR CLAIMS PROCESSING SUBJECT: Tip on the handling of complaints about the NPC and reminder of the legal duty to cooperate with the Justice of Aragon. The Justice of Aragon again reminded (again) to the Minister of Environment has a statutory duty to collaborate with this institution. Since again has given no answer to a request for information on the subject heading this entry.
The Justice Data sued the allegations made by our group in the last five years and the records and resolutions that have resulted. The request for information was reiterated in June 22 and August 13, without being served.
And he said that the Department has an obligation to at least initiate and resolve all allegations presented. Something that anyone seems obvious, but actually not the case.
And if not, has to read carefully the report of Justice where it is stated that in 2009 only 25% of complaints made by us in the Provincial Service Zaragoza ended in a resolution, or in front of the sixty complaints during 2008 and 2009 on Biodiversity has not initiated a single file, as is the case with the complaints on the same cattle trails in the Provincial Service .
Therefore, in relation to this complaint, the Justice has issued the following resolution:
First .- make suggestions to the Department of Environment to give the prosecution of such complaints from agents or Nature Protection , those arising in its scope by any other means provided for in the Rules of Procedure for the exercise of the power to sanction either of the Community of Aragón, instituting the mandatory records and issuing the appropriate decision in each case.
Second .- Perform the same department a Reminder of statutory duty on its obligation to assist the institution in research, as provided in Article 19 of that Law 4 / 1985.
